1. Agreement and eligibility
These terms govern your use of Phoenix-Fitness (“PF”). By creating an account or using PF, you agree to these terms and the Privacy Policy. If you do not agree, do not use the service.
You must be at least 18 years old and legally able to enter this agreement. PF is currently designed for iPhone, in English, and for personal fitness and nutrition planning.
2. What PF provides
PF provides editable workout templates, workout execution and logs, nutrition planning and logs, progress tracking, optional device integrations, and—where enabled—AI-assisted workout and nutrition proposals.
The free tier provides approved editable seven-day templates selected by requirements or sport. AI generation is not included in the free tier. Paid availability, feature flags, provider capacity, regional restrictions, and device capability may affect optional features.
3. Your account
- Provide accurate information and keep it current, especially restrictions, allergies, equipment, and goals.
- Keep credentials and your device secure. You are responsible for activity performed through your account unless you promptly report unauthorised use.
- Do not share passwords, recovery codes, purchase receipts, or AI-provider keys.
- Use only one person’s profile per account; plans are generated for the saved account profile.
4. Fitness, nutrition, and medical limits
PF is not medical care. It does not diagnose, treat, cure, or prevent disease, and it does not replace a doctor, dietitian, physiotherapist, emergency service, or other qualified professional.
Exercise and dietary change involve risk. You are responsible for choosing appropriate loads, technique, food, portions, environments, and progression; following clinician instructions; and stopping when symptoms make continued activity unsafe. 5. AI proposals
AI output can be incomplete, incorrect, unsuitable, or inconsistent. PF treats it as a proposal. Schema validation, deterministic limits, and warnings reduce risk but do not make an AI model a professional. You must review and explicitly approve a proposal before it becomes an active plan.
Do not use PF or an attached model to seek diagnosis, emergency instructions, prescription advice, eating-disorder treatment, prohibited performance-enhancing drug protocols, or unsafe rapid weight change. PF may refuse or constrain requests that conflict with product safety rules.
6. Subscriptions and credits
Pro may be offered as monthly or annual auto-renewing subscriptions through Apple. Apple controls purchase confirmation, billing, renewal, cancellation, and refunds under your App Store account and applicable Apple terms. Prices and taxes are shown before purchase.
Managed-AI requests may require credits in addition to an active Pro entitlement. Credits do not bypass Pro. Purchased credits do not expire unless law permits and the purchase disclosure states otherwise; promotional credits may have a stated expiry. A failed provider call or invalid proposal must not settle a credit charge.
Deleting PF does not automatically cancel an Apple subscription and does not itself create a refund. Manage subscriptions at Apple Subscriptions. Restore purchases is available in PF where commerce is enabled.
7. Content and licence
PF and its original templates, interface, software, and brand are protected by intellectual-property law. We grant you a limited, revocable, non-exclusive, non-transferable licence to use PF for personal purposes under these terms.
You retain rights in notes, photos, logs, and other content you provide. You grant PF the limited right to host, process, transform, and transmit that content only as needed to operate, secure, improve, export, and support the service in line with the Privacy Policy.
8. Acceptable use
Do not misuse PF, probe or bypass access controls, access another user’s data, automate abusive requests, resell the service or credits, manipulate purchase verification, upload unlawful or malicious material, infringe rights, or use PF to facilitate harm. You may not reverse engineer PF except where applicable law expressly permits it.
9. Availability and changes
PF may change, suspend, or retire functionality for security, legal, provider, technical, or product reasons. We aim to preserve user-edited plans and provide notice of material changes where practical. Offline functionality, third-party services, and beta or gated features may not always be available. No service is guaranteed to be uninterrupted or error-free.
10. Suspension, deletion, and termination
You may stop using PF or delete your account at any time. We may restrict or terminate access for material breach, fraud, security risk, unlawful use, or where required by law, using a proportionate process where circumstances allow. Terms that by nature should survive—such as payment records, intellectual property, disclaimers, and dispute provisions—remain effective after termination.
11. Disclaimers and responsibility
To the extent permitted by law, PF is provided “as is” and “as available”. We do not warrant that a plan will achieve a particular body weight, appearance, performance, health outcome, competition result, or timeframe.
Nothing in these terms excludes rights or liability that applicable law does not permit us to exclude. Otherwise, PF is not responsible for indirect or consequential loss, or loss caused by inaccurate inputs, disregarded warnings, unsafe execution, third-party services, or use outside the product’s intended purpose.
12. Governing law and contact
These terms are governed by the laws of South Africa, without removing any mandatory consumer rights you have where you live. We encourage you to contact PF first so we can try to resolve a concern promptly.
